Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Anthem Studio website at anthemstudio.ai and the Anthem Studio platform (collectively, the "Service"), operated by Anthem Studio ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We are not liable for any loss arising from unauthorized access to your account.

You may invite team members to your workspace. As the account owner, you remain responsible for all actions taken by team members within your workspace.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Generate, distribute, or publish content that is defamatory, obscene, fraudulent, or infringes on any third party's rights.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or any systems or networks connected to the Service.
  • Use the Service to send unsolicited bulk communications (spam) through email or social media features.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use automated means (bots, scrapers) to access the Service beyond what is provided through our official features.
  • Resell, sublicense, or provide the Service to third parties as a managed service without our written consent.

We reserve the right to suspend or terminate your account if we reasonably believe you are in violation of these Terms.

4. AI-Generated Content

The Service uses artificial intelligence to generate marketing content, including text, images, and other media. You acknowledge that:

  • You are responsible for reviewing all AI-generated content before publishing or distributing it. AI outputs may contain errors, inaccuracies, or content that does not align with your brand.
  • AI outputs are not guaranteed to be unique. Similar prompts may produce similar outputs for different users.
  • We do not guarantee compliance of AI-generated content with industry-specific regulations (e.g., financial, healthcare, legal). You are solely responsible for ensuring compliance with applicable laws and regulations.
  • Content is processed by third-party AI providers (Anthropic, OpenAI, Google) subject to their respective terms and policies.

5. Your Content

You retain ownership of all content you upload, create, or generate through the Service ("Your Content"), including brand assets, marketing copy, images, and campaign data.

By using the Service, you grant us a limited, non-exclusive license to host, store, process, and display Your Content solely for the purpose of providing and improving the Service. This license ends when you delete Your Content or close your account.

You represent that you have all necessary rights to use any content you upload and that Your Content does not infringe on any third party's intellectual property rights.

6. Connected Accounts & Third-Party Platforms

The Service allows you to connect third-party accounts (e.g., Facebook, Instagram, LinkedIn, X/Twitter, TikTok, Pinterest, Google Workspace, Canva). When you connect a third-party account:

  • You authorize us to access and interact with those platforms on your behalf, including publishing content and retrieving analytics.
  • You remain bound by the terms of service of each connected platform.
  • We are not responsible for any changes, outages, or actions taken by third-party platforms that may affect the Service.
  • You may disconnect any third-party account at any time through your account settings.

7. Subscriptions & Payment

The Service offers free and paid subscription plans. By subscribing to a paid plan:

  • You authorize us to charge the payment method on file through our payment processor, Stripe, on a recurring basis according to your chosen billing cycle.
  • Subscription fees are billed in advance and are non-refundable, except where required by law.
  • We may change pricing with at least 30 days' notice. Price changes take effect at the start of your next billing cycle.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period, and you will retain access until then.

Each plan includes usage limits (e.g., AI generation credits, connected accounts, team members). If you exceed your plan's limits, we may restrict access to certain features until the next billing cycle or require an upgrade.

8. Intellectual Property

The Service, including its design, features, code, documentation, and branding, is owned by Anthem Studio and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand elements without prior written consent.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure.
  • AI-generated content will be accurate, complete, or suitable for any particular purpose.
  • Content published through the Service will achieve any specific marketing results or performance metrics.
  • Third-party platform integrations will remain available or function without interruption.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANTHEM STUDIO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total aggregate liability for all claims arising from or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Anthem Studio and its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Content you create, generate, or publish through the Service.
  • Your violation of any third party's rights, including intellectual property rights.

13. Termination

You may close your account at any time by contacting us or through your account settings. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.

Upon termination:

  • Your right to use the Service ceases immediately.
  • We will delete your data in accordance with our Privacy Policy.
  • Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we may also notify you via email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law & Disputes

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good faith negotiation. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration, except where prohibited by law.

16. General

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Anthem Studio regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
